Terms of Service

1. Agreement

By accessing or using Sunshine Hub (the "Service"), operated by Julien Sare (ABN: 98 410 112 931), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Sunshine Hub is a hyperlocal business directory for the Sunshine and Brimbank community in Victoria, Australia. We provide free and paid business listings, search functionality, reviews, maps, and related features to connect local businesses with customers.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Business Listings

• Business listings must be for genuine businesses operating in the Sunshine and Brimbank area (City of Brimbank, Victoria).
• You must have the authority to list a business. Ownership claims are subject to verification.
• All listings are subject to review and approval. We reserve the right to reject, edit, or remove any listing at our discretion.
• You are responsible for keeping your listing information accurate and up to date.
• Listings must not contain misleading, fraudulent, or illegal content.

5. Paid Plans and Payments

• Paid plans (Pro, Hero) are subscription-based and billed monthly through Stripe.
• Prices are in Australian Dollars (AUD) and inclusive of GST where applicable.
• Subscriptions renew automatically unless cancelled before the next billing period.
• Boost purchases are one-time payments and are non-refundable once the boost period has started.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Refund requests for subscriptions may be considered on a case-by-case basis within 14 days of purchase.

6. Reviews and User Content

• Reviews must be honest, based on genuine experience, and relevant to the business being reviewed.
• You must not post defamatory, abusive, discriminatory, or illegal content.
• By submitting a review or other content, you grant Sunshine Hub a non-exclusive, royalty-free licence to display and use that content on our platform.
• We reserve the right to moderate, edit, or remove reviews that violate these terms.
• Business owners may respond to reviews but must not harass or intimidate reviewers.

7. Prohibited Conduct

You must not:

• Use the Service for any unlawful purpose or in violation of Australian law
• Submit false, misleading, or spam business listings
• Scrape, crawl, or harvest data from the Service without permission
• Attempt to gain unauthorised access to other accounts or our systems
• Post fake reviews or manipulate ratings
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or business

8. Intellectual Property

The Sunshine Hub name, logo, website design, and original content are owned by us and protected by Australian intellectual property laws. Business listing content remains the property of the respective business owners. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by Australian Consumer Law. We do not guarantee the accuracy, completeness, or reliability of any business listing, review, or other content on the platform. We do not endorse any business listed on Sunshine Hub unless explicitly stated as a "Top Pick."

10. Limitation of Liability

To the maximum extent permitted by law, Sunshine Hub and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim. Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

11. Disputes Between Users

Sunshine Hub provides a platform for businesses and consumers to connect. We are not a party to any transaction or interaction between users. Disputes between business owners and reviewers, or between competing ownership claimants, should be resolved between the parties. We may provide dispute resolution tools but are not obligated to mediate.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Active paid subscriptions will not be refunded for the current billing period upon termination for terms violations.

13. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be posted on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
